The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated June 16, 1998, and duly recorded in the Office of the Clerk of the County Commission of Brooke County, West Virginia, in Deed of Trust Book 328, at Page 172, Donald D. Forester and Nancy A. Forester did convey unto Jennifer Rhodes, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Brooke County Courthouse, in Wellsburg, West Virginia, on

FOR 223.48 FEET TO AN IRON PIN; THENCE WITH LIN OF W. NECHLING N. 1 DEGREES 39’ E. FOT 107.80 FEET TO AN IRON PIN; THENCE WITH REMAINING LAND OF OLIVER JONES N. 28 DEGREES 15’ E. FOR 164.09 FEET TO AN IRON PIN IN THE WEST LINE OF SAID 30 FOOT LAND; THENCE N. 55 DEGREES 15’ E. FOR 15 FEET TO THE PLACE OF BEGINNING, CONTAINING 0.43 ACRE, MORE OR LESS, AND BEING A PART OF THE 17.3 ACRE TRACT OF LAND CONVEYED TO JONES BY DEED WHICH IS OF RECORD IN DEED BOOK 139 PAGE 395 IN THE BROOKE COUNTY RECORDS.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of Rd 1 Box 70H, Colliers, WV 26035.
AND BEING the same real estate which was conveyed to Donald D. Forester and Nancy A. Forester, by Deed dated November 5, 1980, from Richard M. Jones and Hattie Jones, and recorded in the Office of the Clerk of the County Commission of Brooke County, West Virginia, in Deed Book 223 at Page 748.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
