Activity:
To operate and maintain an existing combined wastewater collection system and an existing 0.2 million gallons per day wastewater treatment plant. These facilities are designed to serve a population equivalent of approximately 2,000 persons in the Town of Bethany, including Bethany College, and environs, and discharge treated wastewater through Outlet No. 001 to Buffalo Creek, approximately 20.1 miles from its mouth of the Ohio River. An antidegradation review was performed. Tier 1 protection is afforded for the uses specified in Title 47, Series 2, Section 6 for Outlet No. 001. To operate and maintain disposal systems, best management practices, and the nine (9) minimum controls for the direct discharge of sanitary wastewater and storm water from Combined Sewer Overflow (CSO) Outlet No. C004 to Buffalo Creek of the Ohio River. This CSO outlet is permitted to discharge only when the hydraulic capacity of the collection system is exceeded during wet weather events. Tier 1 protection shall be afforded for the uses specified in 47 CSR 2 for the CSO outfall through implementation of the facility’s Long-term Control Plan.

The combined sewer overflow requirements of the permit shall be attained through Administrative Order No. 6864 and any amendments, thereto. Also, requirements of the permit shall be attained through Order No. 9864, issued April 16, 2020 and any amendments, thereto.
On the basis of review of the application, the “Water Pollution Control Act (Chapter 22, Article 11-8(a)),” and the “West Virginia Legislative Rules,” the State of West Virginia will act on the above application.
Any interested person may submit written comments on the draft permit and may request a public hearing by addressing such to the Director of the Division of Water and Waste Management within 30 days of the date of the public notice. Such comments or requests should be addressed to:

The public comment period begins July 26, 2024 and ends August 25, 2024.
Comments received within this period will be considered prior to acting on the permit application. Correspondence should include the name, address and the telephone number of the writer and a concise statement of the nature of the issues raised. The Director shall hold a public hearing whenever a finding is made, on the basis of requests, that there is a significant degree of public interest on issues relevant to the Draft Permit(s). Interested persons may contact the public information office to obtain further information.
