Notice of Public Auction

NOTICE OF PUBLIC AUCTION

PLEASE TAKE NOTICE that, by Ordinance duly passed by the City Council of the City of Follansbee, West Virginia, the undersigned has been fully empowered and authorized to sell at public auction certain real property owned by the City of Follansbee. Accordingly, pursuant to such authority, the undersigned shall sell at public auction the following described valuable real estate:

ALL that certain lot or parcel of land situate in the City of Follansbee, Follansbee District, Brooke County, West Virginia containing 0.9438 acres, more or less. Subject to any and all legal highways, rights-of-way and/or easements, leases and options, conditions, restrictions, reservations, and/or exceptions of record, and to all applicable zoning regulations and/or ordinances. Subject, further, to all conditions, restrictions, reservations, and/or exceptions established by the City of Follansbee which shall run with the land in pursuance of its development plan for the subject property and the surrounding parcel. Copies of the exact legal description for the subject parcel, survey plat, and the City’s conditions, restrictions, reservations, and exceptions may be viewed at the Follansbee City Manager’s Office, 872 Main Street, Follansbee, West Virginia, 26037, from Monday through Friday, 9:00 a.m. to 4:00 p.m., except holidays.

THE above property to be sold is located in the City of Follansbee, Brooke County, West Virginia, at the intersection of West Virginia Route 2 and Mahan’s Lane, and contains 0.7739 acres, more or less, from Map No. F14, Parcel No. 10, and 0.1699 acres, more or less, from Map No. F14, Parcel No. 11.

TIME OF SALE: Wednesday, August 14, 2024, at 2:00 p.m.

PLACE OF SALE: At the front door of the Follansbee City Building located at 872 Main Street in Follansbee, Brooke County, West Virginia.

CHANGE OF AUCTION DATE AND TIME: The undersigned reserves the right to change, amend, and/or move the place, date, and/or time of the subject auction, and/or to cancel the subject auction, at any time without cause.

TERMS OF SALE: The subject real estate is being sold “AS IS”. The minimum bid to be considered by the undersigned for the purchase of the subject property shall be $400,000.00 or higher. Purchase price shall be paid in full in cash or by cashier’s check in hand on the day of sale or, in the alternative, a $1,000.00 non-refundable earnest money deposit paid in cash or by cashier’s check on the day of sale with the entire remaining balance to be paid in full in cash or by cashier’s check upon completion of a due diligence process, which shall not exceed ninety (90) days without mutual agreement of the parties. The subject property shall be conveyed by special warranty deed and shall be subject to numerous restrictions, reservations, and conditions which shall run with the land. The successful bidder shall be required to enter into a sales contract on the date of sale indicating the terms and conditions of sale and outlining the requirements to finalize the subject transaction.

REFUSAL OF BIDS: The undersigned reserves the right to reject any and all bids.

COUNCIL APPROVAL: No sale shall be final until approved by resolution of the City Council of the City of Follansbee, West Virginia.

INSPECTION: The subject property may be inspected by making an appointment with the Follansbee City Manager by calling (304) 527-1330, from Monday through Friday, between the hours of 9:00 a.m. and 4:00 p.m., except holidays.
