The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated August 25, 2006, and duly recorded in the Office of the Clerk of the County Commission of Brooke County, West Virginia, in Book No. 455, at Page 796, Shannon L Ridgely and Kaili N Ridgley did convey unto William Ihlenfeld Sr., Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by U.S. BANK TRUST NATIONAL ASSOCIATION, NOT IN ITS INDIVIDUAL CAPACITY BUT SOLELY AS OWNER TRUSTEE FOR RCF2 ACQUISITION TRUST to foreclose thereunder, will offer for sale at public auction at the front door of the Brooke County Courthouse in Wellsburg, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 03 – Buffalo District, Brooke County, West Virginia, and more particularly described as follows:
PARCEL I
All that certain tract or parcel of land situate in Buffalo District, Brooke County, West Virginia, being more particularly bounded and described as follows, to-wit:
Beginning at a fence post corner to lands of Michael Whitco, said post being located at the east side of the Genteel Ridge County Road; thence with the east side of said road S. 37° 00’ W. 60.0 feet to a stake, the true place of beginning of the property to be herein conveyed; thence through lands of Whitco S. 39° 15’ E. 250.0 feet to a stake; thence S. 37° 00’ W. 125.0 feet to a stake; thence N. 39° 15’ W. 250.0 feet to a stake at the side of the above mentioned county road; thence with the east side of said road N. 37° 00’ E. 125.0 feet to the place of beginning, containing 0.72 acre, more or less, according to a survey conducted by H. C. Fell, Surveyor, License No. 424 in the month of June, 1977.
PARCEL II
All that certain parcel of land situate in the District of Buffalo, County of Brooke, State of West Virginia, being more particularly described as follows:
BEGINNING at a post, corner to lands of Michael H. Whitco, Deed Book 223, Page 97, said post being in the line of lands of R. Graham, Deed Book 243, Page 500, also being in an original line fence, common to both tracts and said post being on the east side of Genteel Ridge Road; thence leaving said post and with east side of Genteel Ridge Road, south 22° 26’ 0911 west a distance of 285 feet to an iron pin, corner to lands of Ridgely, Deed Book 211 , Page 4 7, and the true place of beginning of the property here to be conveyed; thence leaving said road and with the south line of Ridgely lands, south 53° 48’ 5211 east a distance of 250 feet to a pin; thence south 30° 09’ 14’ west a distance of 86.63 feet to a post; thence north 56° 27’ 51” west a distance of 96.52 feet to a pin on the north line of a twenty foot right-of-way to the M. Whitco farm, Deed Book 176, Page 205; thence with the north line of said right-of-way, north 57° 48’ 06” west a distance of 138.48 fact to an iron pin, corner on the east side of Genteel Ridge Road; thence with said road, north 22° 26’ 08” east a distance of 103 .20 feet to the place of beginning, containing 0.517 acres, more or less and being a fractional part of lands of M. Whitco, Sr., Deed Book 176, Page 205. Survey by G. W. Bullock, P.E. #7187 WV.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 229A Genteel Ridge Road, Wellsburg, WV 26070.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $8000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
