TIME OF SALE: Saturday, October 12, 2024, at 10:00 a.m.

PLACE OF SALE: At the front door of the Wellsburg City Building located at 70 Town Square in Wellsburg, Brooke County, West Virginia.

CHANGE OF AUCTION DATE AND TIME: The undersigned reserves the right to change, amend, and/or move the place, date, and/or time of the subject auction, and/or to cancel the subject auction, at any time without cause.

TERMS OF SALE: All real estate is being sold “AS IS.” Purchase price shall be paid in full in cash or by cashier’s check in hand on the day of sale or, in the alternative, a $1,000.00 non-refundable earnest money deposit paid in cash or by cashier’s check on the day of sale with the entire remaining balance to be paid in full in cash or by cashier’s check upon completion of a due diligence process, which shall not exceed forty-five (45) days without mutual agreement of the parties. The subject properties shall be conveyed by general warranty deed and shall be subject to any and all restrictions, reservations, and conditions which may run with the land or that may be required by Seller. The successful bidder for each property shall be required to enter into a sales contract on the date of sale indicating the terms and conditions of sale and outlining the requirements to finalize the subject transaction.

MINIMUM BID AUCTION: This shall be a minimum bid auction, and each property is listed herein with a pre-determined minimum price that is non-negotiable.

REFUSAL OF BIDS: The undersigned reserves the right to reject any and all bids.

COUNCIL APPROVAL: No sale shall be final until approved by resolution of the City Council of the City of Wellsburg, West Virginia.

INSPECTION: The subject properties may be inspected by making an appointment with the Wellsburg City Manager by calling (304) 737-2104, from Monday through Friday, between the hours of 9:00 a.m. and 4:00 p.m., except holidays.
