The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated April 20, 2007, and duly recorded in the Office of the Clerk of the County Commission of Brooke County, West Virginia, in Deed of Trust Book 464, at Page 487, Vi-Eva R. Ferda and Brian T. Ferda did convey unto Charles Johnson, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Brooke County Courthouse, in Wellsburg, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Cross Creek District, Brooke County, West Virginia, and more particularly described as follows:
TRACT 1
All those certain tracts or parcels of land situate in Cross Creek District, Brooke County, West Virginia, Brooke County, West Virginia, particularly described as follows:
PARCEL NO. 1: BEGINNING at a point in the centerline of a 30’ right of way said point being located the following bearings and distances from an iron pin at the northwest corner of a 1.0 acre parcel conveyed to Earl C. McLaughlin, Jr., et ux and recorded in the records of Brooke County in Deed Book 139, Page 479; N. 58° 22’ E. 15.35’ to a point in the centerline of a 30’ right of way; thence S. 19° 16’ E., 103.42’ to said point of beginning; thence N. 70° 44’ E., 215.00’ to an iron pin passing a stake at 15.00’; thence S. 19° 16’ E., 100.00’ to an iron pin; thence S. 70° 44’ W., 215.00’ to a point in the centerline of a 30’ right of way passing a stake at 200.00’; thence N. 19° 16’ W., 100.00 to the place of beginning containing 0.494 acre more or less being Lot No. 6 on an unrecorded plat of Country Haven Estates. There is excepted from the above described lot a 15’ right of way on the west line as shown on the above mentioned plat.
PARCEL NO. 2: BEGINNING at a point in the center line of a 30 foot right of way, known as Aspen Avenue, said point being located by the following bearings and from the Northwest corner of a 1.0 acre tract of land conveyed to Earl C. McLaughlin, Jr., et ux and recorded in the records of Brooke County in Deed Book 139, Page 479; thence N. 58° 22’ E. 15.35 feet to a point in said Aspen Avenue, a 30 foot right of way; thence with the West Line of Lot No. 5 & 6, and the center line of Aspen Avenue, S. 19° 16’ E. 203.42 feet to the true place of beginning of the property here to be conveyed; thence leaving said road and with the common line of Lots 6 and 7, N. 70° 44’ E. 215 feet to an iron pipe corner to said lots; thence S. 19° 16’ E. 115 feet, passing through an iron pipe marker at 100 feet, to a point in the center of another 30 foot right of way, known as Walnut Drive; thence with said center line S. 70° 44’ W. 215 feet to a point at the intersection of the center line of Walnut Drive and Aspen Avenue; thence with the center line of Aspen Avenue N. 19° 16’ W. 115 feet to the place of beginning containing 0.568 acres, more or less and being Lot No. 7 on an unrecorded Plat of Country Haven Estates. There is excepted from the above described lot, a 15 foot right of way for the aforementioned streets on the West and South lines as shown on the above mentioned plat.
BEING the same property conveyed to Brian T. Ferda and Vi-Eva Ferda, his wife, by deed from Donald Lizon and Mary Lizon, his wife, which said deed is dated September 27, 1988, and recorded in the aforesaid Clerk’s office in Deed Book 247, at page 539, and by Deed of Correction dated November 5, 1988, and recorded in said Clerk’s office in Deed Book 247, at Page 539.
This conveyance is made subject to any and all conditions, restrictions, out conveyances, reservations and exceptions made and properly of record relative to said property.
TRACT 2
ALL that certain tract or parcel of land situate in Cross Creek District, Brooke County, West Virginia, more particularly described as follows:
BEGINNING at a point in the centerline of a 30’ right of way located N. 58° 22’ E., 15.35’ from an iron pin at the northeast corner of a 1.0 acre parcel conveyed to Earl C. Mclaughlin Jr., et us and recorded in the records of Brooke County in Deed Book 139, page 479; thence N. 58° 22’ E. 220.11’ to an iron pin; thence S. 19° 16” E., 150.56’ to an iron pin; thence S 70° 44’ W., 215.00 to a point in the centerline of said right of way, passing a stake at 200.00’; thence N 19° 16’ W., 103.42’ to the place of beginning being Lot No. 5 on an unrecorded plat of Country Haven Estates and containing 0.627 acre more or less.
SCHEDULE “A”
There is excepted from above described parcel a 15’ right of way along the westerly line as shown on above mentioned plat.
This conveyance is made subject to any and all restrictions, out-conveyances, conditions, reservations and exceptions, etc., made and properly of record relative to said property.
BEING the same property conveyed to Brian T. Ferda and Vi-Eva R. Ferda, husband and wife, by deed from William Thomas and Shirley Thomas, husband and wife, which said deed is dated November 16, 1991, and recorded in the aforesaid Clerk’s office in Deed Book 258, at page 343.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 150 Aspen Avenue, Wellsburg, WV 26070.
AND BEING the same real estate which was conveyed to Vi-Eva R. Ferda and Brian T. Ferda, by Deed dated September 27, 1988, from Donald Lizon and Mary Lizon, and recorded in the Office of the Clerk of the County Commission of Brooke County, West Virginia, in Deed Book 247, at Page 539.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
