TRUSTEE’S SALE OF VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated June 29, 2005, and duly recorded in the Office of the Clerk of the County Commission of Brooke County, West Virginia, in Deed of Trust Book 439, at Page 186, Lindy L. Galiano and Santy Galiano did convey unto Lisa M. Bagay, Summer Liberati, Musser and Bagay, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Brooke County Courthouse, in Wellsburg, West Virginia, on

December 18, 2024, at 8:50 AM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Cross Creek District, Brooke County, West Virginia, and more particularly described as follows:
That certain parcel of land located in the Cross Creek District of Brooke County, West Virgina, bounded and being more particularly described as follows, to wit:

Beginning at a rebar found at the southernmost corner of the parcel of land to be described herein. Said point is situated at the northwest corner of a 1.01 acre parcel of land that was conveyed from Pauline Sullivan to Janice Friend by deed dated January 5, 1998, and recorded in the Office of the Clerk of the County Commission of Brooke County, West Virginia, in Deed Book No. 279, at page 663.

Thence, from the said place of beginning, N. 41° 54’ 00” E. passing on line a rebar found at 129.54 feet, for a total distance of 353.19 feet to a rebar found at the northeast corner of a 2.19 acre tract of land conveyed to William Marino in Deed Book No. 217, at Page 560. Said point also in the line of a 2.105 acre parcel of land that was conveyed to Robert and Delores Kline in Deed Book No. 138, at Page 212. Thence, with the lands of the 2.105 acre Kline parcel, N. 63° 56’ 00” W. for a distance of 20.65 feet to a rebar found at the southwest corner thereof. Thence, N. 30° 26’ 00” E. for a distance of 309.00 feet to a rebar set. Thence, leaving the lands of the aforesaid 2.105 acre Kline parcel, now with the westernmost lines of a 7.60 acre tract of land that was conveyed to William Morgan and Doris Jean Rouse by Deed dated July 12, 1978 and of record in Deed Book No. 214, at page 443, for the following three (3) courses: N. 02° 55’ 54” W. for a distance of 390.05 feet to a 48” oak stump; N. 63° 34’ 08” W. for a distance of 292.00 feet to a rebar set; N. 24° 38’ 08” W. for a distance of 790.00 feet to a rebar set in the eastern margin of Putney Ridge Road (Brooke County Route No. 7/3). Thence, leaving the lands of the said 7.60 acre Rouse tract now with the said road, for the following five (5) courses: S. 06° 55’ 10” W. for a distance of 94.57 feet to a point; S. 11° 31’ 17” W. for a distance of 164.00 feet to a point; S. 21° 53’ 07” W. for a distance of 119.11 feet to a point; S. 28° 30’ 02” W. for a distance of 145.05 feet to a point; S. 38° 13’ 15” W. for a distance of 199.80 feet to a point.

Thence, leaving the road and with the easternmost lines of a 3.382 acre tract of land that was conveyed to James M. and Jackie Moses by Deed dated March 21. 1989, and recorded in Deed Book No. 249, at Page 252 (Parcel B), for the following two courses: S. 35° 13’ 10” E. passing on line a rebar set at 14.59 feet, for a total distance of 671.84 feet to a set rebar. Thence, S. 31° 58’ 52” W. for a distance of 140.94 feet to a set rebar at the northeast corner of a 0.153 acre parcel of land that was conveyed to Harry and Charlotte Mitchell by Deed dated May 8, 1987, and recorded in Deed Book No. 242, at Page 745.

Thence, with the lands of Mitchell for the following three (3) courses: S. 32° 34’ 46” E. for a distance of 25.00 feet to a set rebar, thence, thence S. 24° 40’ 10” E. for a distance of 208.00 feet to a set rebar, S. 40° 19’ 50” W. for a distance of 45.38 feet to a set rebar at the northeast corner of a 2.09 tract of land that was conveyed to Harry L. and Charlotte P. Mitchell by Deed dated August 24, 1983, and of record in Deed Book No. 230, at Page 779. Thence, S. 32° 14’ 00” E. for a distance of 252.25 feet to the place of beginning, containing 15.978 acres as shown upon a plat recorded heretofore in the Office aforesaid.

Being the same property conveyed to Lindy L. Galiano, by deed from Edward Carter and Deborah Carter, husband and wife, dated July 27, 1998 and recorded August 3, 1998, in the office of the Clerk of the County Commission of Brooke County, West Virginia, in Deed Book 281, at page 198. Also being the same property, a ½ interest of which was conveyed to Santy Galiano by deed from Lindy L. Galiano dated and recorded April 23, 2004, in said Clerk’s office in Deed Book 307, at page 252.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of RR 1 Box 155A, Putney Ridge Road, Colliers, WV 26035.

AND BEING the same real estate which was conveyed to Lindy L. Galiano and Santy Galiano, by Deed dated July 27, 1998, from Edward Carter and Deborah Carter, and recorded in the Office of the Clerk of the County Commission of Brooke County, West Virginia, in Deed Book 281, at Page 198.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
