The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated June 24, 2016, and duly recorded in the Office of the Clerk of the County Commission of Brooke County, West Virginia, in Deed of Trust Book 552, at Page 623, James Morris did convey unto Marc J. Slotnick, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Brooke County Courthouse, in Wellsburg, West Virginia, on
July 9, 2025, at 9:49 AM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Wellsburg District, Brooke County, West Virginia, and more particularly described as follows:
All that certain parcel of ground located in Wellsburg District, Brooke County, West Virginia, and
more particularly described as follows, to-wit:
Located on the west side of Main Street and beginning at a point on the west line of Main Stree
60 feet south of the intersection of 15th Street and Main Street; thence continuing along the east
line of Main Street 34 feet 1 ½ inches to a point thereon; thence westwardly at right angles to
Main Street for a distance of 147 feet 11 inches along the property line of Sara E. Kirk to a point
corner to lands of Dorsay; thence at right angles northwardly 94 feet 1 ½ inches to a point on the
South line of 15th Street; thence Eastwardly along the south line of said 15th Street for a distance
of 13 feet to a point thereon; thence Southwardly at right angles to 15th Street for a distance of
60 feet to a point; thence Eastwardly for a distance of 134 feet 11 inches to the place of beginning.
BEING the same property as that conveyed to the Borrower herein by Deed of Sharon M. Welch
dated June 24, 2016, and intended to be recorded contemporaneously herewith.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing
address of 1451 Main Street, Wellsburg, WV 26070.
AND BEING the same real estate which was conveyed to James Morris, by Deed dated June 23, 2016, from Sharon M. Welch, and recorded in the Office of the Clerk of the County Commission of Brooke County, West Virginia, in Deed Book 368, at Page 274.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
