NOTICE OF SALE
(Old Wellsburg Middle School Property, Wellsburg, WV – OHIO RIVER FRONTAGE
Please take notice that the Board of Education of the County of Brooke has determined that the below-described real estate is no longer neededd for school purposes and that beginning at 10:00 a.m. on the 20th day of October, 2025, at the old Wellsburt Middle School property, located at 1447 Main Street, Wellsburg, West Virginia, 26070, the Board of Education of the County of Brooke will proceed to sell the surface only, BY QUITCLAIM DEED AND WITHOUT ANY WARRANTY WHATSOEVER, at public auction, subject to all the terms and conditions set forth in this Notice of Sale, and subject to Chapter 18, Article 5, Section 7 of the Code of West Virginia of 1931, as amended, all of its right, title and interest in and to those certain tracts or parcels of real estate, collectively known as the old Wellsburg Middle School property, including any buildings located thereon, and the appurtenances thereunto belonging, situate in the City of Wellsburg, in Wellsburg Corp. District, Brooke County, West Virginia, and which said real estate is more particularly described as follows:
TRACT ONE:
A tract or parcel of lande near the town of Wellsburg, Brooke County, West Virginia containing
about eight and half acres bounded on the North by lands of John Miller, on the East by a road,
on the South by lands of Joseph Stewart, and on the West by the Ohio River, being a part of
what was called Prathers Lower Farm and represented on the plat of division of the same matter
by the Executors of said Prather and duly recorded in the Clerk’s Office aforesaid as lots eleven
(11), thirteen (13), and fifteen (15).
Being the same property conveyed to The Board of Education of the Independent District of Wellsburg, by deed dated December 31, 1923, from Eagle Manufacturing Company, and of record in the Office of the Clerk of the County Commission of Brooke Conuty, West Virginia, in Deed Book 54, page 30.
TRACT TWO:
A certain lot or parcel of land, situate on a portion on that land which was conveyed to Ida
Garrison by deed from Ella Campbell and Lemuel Campbell, her husband, dated the 8th day of
January, 1909, and recorded in the Office of the Clerk of the County Court of Brooke County,
West Virginia, in Deed Book No. 43 at page 153 and more particularly bounded and desribed
as follows:
BEGINNING at a point on the west side of Main Street in the City of Wellsburg, Brooke County,
West Virginia, at a corner of lands formerly belonging to Mrs. Etta Ralston and the John Ervin
heirs; now known as the High School property; thence with the West line of Main Street, south
15º 15’ West 52 feet to a stake; thence North 74º 45’ West (parallel with the southern bondary
line of the property conveyed to Ida Garrison by deed from Ella Campbell and Lemuel Campbell,
her husband, and of record in the deed records of Brooke County, West Virginia, in Deed Book
43 page 152, to a stake in the line of lands of W.H. Harvey heirs; thence along the line of the said
W.H. Harvey heirs, North 40º East to th line of land formerly belonging to John Ervin, now known
as the High School property; thence with the line of the said High School property, South 84º
55’ East 21.6 feet to the place of beginning; being a piece or parcel of that land conveyed to Ida
M. Garrison, et vir., by Ella Campbell, et vir., and fronting 52 feet on said Main Street and being
bounded on the South by a line parallel with the southern boundary line of the original piece of
ground as conveyed to the grantors by the said Ella Campbell abd Lamuel Campbell, as
aforesaid.
Being the same property conveyed to The Brooke County Board of Education, by deed dated August 31, 1965, from Floyd E. Chambers, Executor of the Estate of Opal McCombs Wilson, and of record in the Office of the Clerk of the County Commission of Brooke County, West Virginia, in Deed Book 162, page 112.
TRACT THREE:
A parcel of land situate on the West side of Main Street and North of Twelfth Street in said City
and more particularly bounded and described as follows:
BEGINNING at a point in the southernly line of Tract 11, Prathers Division, which was conveyed
by Eagle Manufacturing Company to the Board of Education of the Independent District of
Wellsburg, by Deed dated December 31, 1923, and recorded in the Office of the Clerk of the
County Court of Brooke County, West Virginia, in Deed Book 54, at page 30, said Prathers
Division beign recorded in said County Clerk’s Office in Deed Book 15, at page 624, said
beginning point being the Northwesterly corner of the parcel of land which was conveyed by Ida
May McCombs and Melvin McCombs, her husband, to James R. Wilkin, Trustee, by Deed dated
July 12, 1930 and recorded in said County Clerk’s Office in Deed Book at page; said beginning
point being located N. 74º 45’ W. 21 and 6/10 feet from the Westerly line of Main Street; thence
from said beginning point, and with the Westerly line of said Wilkin property, S. 40º 09’ W. 57 and
33/100 feet to a point; thence with other property now owned by the City of Wellsburg, S. 79º 07’
30” W. 245 and 23/100 feet to a point; thence with the lines of said Board of Education property,
the following three (3) bearings and distances: N. 46º 48’ E. 64 and 7/100 feet to a point; thence
N. 64º 35’ E. 161 and 7/10 feet to a point; thence S. 74º 45’ E. 88 and 14/100 feet to the
place of beginning, containing by survey made by Stegman & Schellhase, Inc., Civil Engineers
and Surveyors, Two Hundred Ninety-nine Thousandths (299/1000) of an acre, more or less.
Being the same property conveyed to The Brooke County Board of Education, by deed dated September 17, 1965, from the City of Wellsburg. and of record in the Office of the Clerk of the County Commission of Brooke County, West Virginia, in Deed Book 162, page 182.
The aforesaid real estate, together with and and all improvements (including the aforesaid school building(s) located thereon, and the appurtenances thereunto belonging, are sometimes collectively referred to below as the “Subject Property.” IT IS THE INTENT OF THE BOARD OF EDUCATION OF THE COUNTY OF BROOKE TO SELL AND CONVEY ALL PROPERTY THAT WAS FORMERLY KNOWN AS WELLSBURG MIDDLE SCHOOL, WHETHER PARTICULARALY DESRIBED HEREIN OR NOT.
The Subject Property is designated by the Brooke County Assessor as being located on part of Tax Map W22P, Parcel 88, Tax map W22P, Parcel 99, and Tax Map W22P, Parcel 100.
The Subject Property will be sold “AS IS” and “WITH ALL FAULTS” and subject to any and all effective and validly continuing and existing rights of way, easements, reservations, exceptions, covenants, obligations, conditions, conveyances, encumbrances, liens, agreements, leases, and other matters whether (a) of record, (b) visible from an on-site inspection or survey of the Subject Prpoerty, or (c) otherwise.
The sale will further be made subject to all information and to such facts as might be revealed by an accurate survey amd visual inspection of the Subject Property. The sale will further be made subject to the purchaser assuming and the deed shall provide that the purchaser assumes (a) all responsibility and liability for hazards associated with the Subject Property (whether past, present, future, known or unknown), including but not limited to, environmental and those associated with or pertaining to asbestos, and (b) any validly continuing and existing covenants or obligations of The Board of Education of the County of Brooke contained in any deeds or other instruments of record in said Clerk’s Office respecting said Subject Property.
The Board of Education of the County of Brooke reserves the right to refuses any and all bids and to adjourn the sale from time to time and place of the sale or any continuance or adjournment thereof. The sale shall be to the highest responsible bidders, but all bids are conditioned upon the acceptance thereof by The Board of Education of t he County of Brooke at its first regular meeting following the auction, which acceptance by The Board of Education of the County of Brooke may be withheld for any reason or no reason whatsoever. The minimum bid for the Subject Property shall be $225,000.00. The sale shall be made upon the following additional terms: ten percent (10%) of the total sales price in cash, together with a letter of credit for the remaining balance at the time of the auction and the balance in cash due simultaneously with the tender by The Board of Education of the County of Brooke of the deed, and such other terms as may be ordered by The Board of Education of the County of Brooke.
