NOTICE OF PUBLIC AUCTION
PLEASE TAKE NOTICE that, by Resolution duly passed by the City Council of the City of Follansbee, West Virginia, the undersigned has been fully empowered and authorized to sell at public auction certain real property owned by the City of Follansbee. Accordingly, pursuant to such authority, the undersigned shall sell at public auction the following described real estate:
ALL that certain lot or parcel of land situate near the City of Follansbee, Cross Creek District, Brooke County, West Virginia containing 1.649 acres, more or less. Subject to any and all legal highways, rights-of-way and/or easements, leases and options, conditions, restrictions, reservations, and/or exceptions of record, and to all applicable zoning regulations and/or ordinances. Subject, further, to all conditions, restrictions, reservations, and/or exceptions established by the City of Follansbee. A copy of the legal description for the subject parcel and the City’s conditions, restrictions, reservations and exceptions may be viewed at the City Manager’s Office, 872 Main Street, Follansbee, West Virginia, from Monday through Friday, 8:30 a.m. to 3:30 p.m., except holidays.
THE above property to be sold is commonly known as the Follansbee Dog Pound and is located along the Follansbee and Eldersville Road near the Follansbee city limits, Brooke County, West Virginia. The subject property contains 1.649 acres, more or less, and is identified by the Brooke County Assessor’s Office as Map No. CC15, Parcel No. 0001.
TIME OF SALE: Wednesday, January 28, 2026, at 2:00 p.m.
PLACE OF SALE: At the front door of the Follansbee City Building located at 872 Main Street in Follansbee, Brooke County, West Virginia.
CHANGE OF AUCTION DATE AND TIME: The undersigned reserves the right to change, amend, and/or move the place, date, and/or time of the subject auction, and/or to cancel the subject auction, at any time without cause and/or public notice.
TERMS OF SALE: The subject real estate is being sold “AS IS” and “WHERE IS”. The minimum bid to be considered by the undersigned for the purchase of the subject property shall be $1,500.00. The purchase price shall be paid in full in cash or by cashier’s check in hand on the day of sale. The subject property shall be conveyed by quitclaim deed and shall be subject to restrictions, reservations, and conditions established by the City of Follansbee which shall run with the land. The successful bidder shall be required to enter into a sales contract on the date of sale indicating the terms and conditions of sale and outlining the requirements to finalize the subject transaction. The herein property is a distressed property. The herein sale shall be strictly contingent upon the successful bidder demolishing and removing all buildings situate on the subject property within 90 days of sale in accordance with the City’s specifications and to the City’s full satisfaction.
REFUSAL OF BIDS: The undersigned reserves the right to reject any and all bids.
COUNCIL APPROVAL: No sale shall be final until approved by Ordinance of the City Council of the City of Follansbee, West Virginia.
INSPECTION: The subject property may be inspected by making an appointment with the Follansbee City Manager by calling (304) 527-1330, from Monday through Friday, between the hours of 8:30 a.m. to 3:30 p.m., except holidays.
