All that certain parcel of land situated in Cross Creek District, Brooke County, West Virginia and more particularly bounded and described as follows:
Beginning at a point located at the center of a bridge across Cross Creek, said point also being located at the southeast corner of a .88 acre parcel that was conveyed to Carl D. and Mary A. Cox by Deed dated July 14, 1955 and recorded in the Office of the Clerk of the County Court of Brooke County, West Virginia, in Deed Book 123 at page 479; thence with the southerly line of said .88 acre parcel and along Cross Creek Road N. 82º 53’ W. a distance of 42.3 feet to a point in said road, thence N. 48º 45’ W. a distance of 145.55 feet to a nail (set) at the southwest corner of said .88 acre parcel, thence leaving said parcel and continuing along said road N. 48º 45’ W. a distance of 74.74 feet to a point in said county road, said point being located at the true place of beginning of the parcel herein described. Beginning at an iron pin found in concrete at the easternmost corner of a .482 acre tract as conveyed to John and Doris Care by Deed on record in the Office of the Clerk of the County Court, Brooke County, West Virginia in Deed Book 219 at page 190; thence through lands of the Grantor South 5 degrees 11 minutes 50 seconds East 73.83 feet to an iron pin; thence South 37 degrees 36 minutes West 20.97 feet to a point in Cross Creek Road; thence with said road North 49 degrees 19 minutes West 12.0 feet to the south east corner of said .482 acre tract; thence with said tract and leaving aid road North 10 degrees 28 minutes East 83.71 feet to the place of beginning containing .022 acres more or less as shown on the plat map attached hereto and made a part of this description. Being a part of the 75 acre tract as on record in the Office of the Clerk of the County Court, Brooke County, West Virginia in Deed Book 28 at page 7.

Beginning at an iron pin found in concrete at the easternmost corner of a .482 acre tract as conveyed to John and Doris Care by Deed on record in the Office of the Clerk of the County Court, Brooke County, West Virginia in Deed Book 219 at page 190; thence with the lines of the .482 acre tract North 32 degrees 33 minutes 50 seconds West 102.83 feet to an iron pin; thence South 68 degrees 16 minutes 10 seconds West 136.66 feet to an iron pin in the east line of the cemetary lot; thence with the line of said cemetary and then through lands of the grantrve North 20 degrees 34 minutes West 324.48 feet to the center of Cross Creek; thence up said creek North 77 degrees 05 minutes 10 seconds East 265.62 feet to a point; thence leaving said creek South 6 degrees 47 minutes 40 seconds East 291.58 feet to an iron pin at a fence post; thence South 1 degree 30 minutes 20 seconds East 109.64 feet to the place of beginning containing 1.675 acres more or less as shown on the plat map attached hereto and made a part of this description. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 4386 Cross Creek Rd, Wellsburg, WV 26070-3067.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $5000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
