TO THE ABOVE NAMED DEFENDANTS:
The object of this action is to QUIET TITLE to certain real property located in the City of Wellsburg, Brooke County, West Virginia, described as follows:

A certain parcel of land, situate upon the southern margin of 28th Street, located in the City of
Wellsburg, Brooke County, West Virginia. Bounded and being more particularly as follows.
Beginning for the same at an iron bar set in the south margin of 28th Street, as its intersection
with the division line between Lot No. 195 and Lot No. 197 as defined upon the “Plan of
Lazearville” of record in the Office of the Clerk of the County Commission of Brooke County,
West Virginia in Deed Book 23 at Page 48. The said point is also located at the northeastern
corner of the same tracts of land that were conveyed to Charles T. Whiteman and Jo Ann
Whiteman, husband and wife, by a deed dated on the 4th day of September, 2015 and is
recorded in the said Clerk’s office in Deed Book 363 at Page 266. Thence, from the said place
of beginning, leaving 28th Street, with the said division line, and also with most eastern line of the
lands of the said Whiteman, S. 00 degrees E. for a distance of 50.00 feet to a set iron bar that is
located at a corner common to the said Whiteman and with the same tracts of land that were
conveyed to Ernest Stucin and Janice Ann Stucin, his wife, by a deed dated on the 11th day of
December, 2015 of record in Deed Book 265 at Page 252. Thence, leaving the said division line
between Lot No. 195 and Lot No. 197, and now with an extension of the last mentioned common
line in an easterly direction, through Lot No. 195, N. 90 degrees 00’ E. for a distance of 10.00 feet
to a set iron bar that is located at the southwestern corner of the 2250 square foot parcel of land
that was conveyed from Belind J. Urso, to Ada Aracich, by deed dated on the 16th day of April,
2019 of record in Deed Book 389 at Page 585, and also at the northwestern corner of the 4500
square foot parcel of land that was conveyed from Cynthia D. Arthurs, single, to Kevin Ray and
Jody Ray, husband and wife, by deed dated on the 29th day of March, 2018 of record in Deed
Book 382 at Page 43. Thence, leaving the lands of the said Ray, and now with the most western
line of the said Aracich parcel; N. 00 degrees 00’ E. passing the northwesterly corner thereof at
25.00 feet, for a total distance of 50.00 feet to a set iron bar that is located at the northwestern
corner of the 2250 square feet parcel of land that was conveyed to Gary C. Reed and Nancy J.
Reed, his wife, by a deed dated on the 13th day of April, 1972 of record in Deed Book 188 at
Page 469 at its intersection with the previously mentioned south margin of 28th Street. Thence,
leaving the aforesaid Reed parcel of land, and now with the afore said south margin of 28th
Street, N. 90 degrees 00’ W. for a distance of 10.00 feet to the place of beginning, containing 500
square feet, more or less, as shown upon a plat that is attached hereto and is intended to be
made a part of this description.

Any person named above or any person who has an interest in this proceeding must appear and defend within thirty (30) days of the first publication of this ORDER; otherwise, a judgment by default will be rednered against any such person at any time thereafter.
