Beginning at a spike in the centerline of Apple Pie Ridge Road at the most northerly corner of a 1 and 572/1000 acre tract of land formerly owned by Glenn I. Francis and Dorothy I. Francis, his wife, said beginning point being located the following thirteen (13) bearings and distances from a point at the most easterly corner of the 94 acre 1 rod tract of land that was conveyed by Charles L. Boner, to Ralph W. Wilson and Olive M. (at 171 and 4/10 feet passing a stake, and at 334 and 28/100 feet passing an iron pin) 350 feet to a spike in the aforesaid centerline of Apple Pie Ridge Road; thence with same the following three (3) bearings and distances: S. 71º 42’ E. 79 and 21/100 feet to a point; thence S. 63º 06’ E. 54 and 1/10 feet to a point; thence S. 52º 03’ E. 50 and 82/100 feet to the place of beginning, containing by survey made by Stegman & Schellhase, Inc., Civil Engineers and Surveyors, 1 and 572/1000 (one and five hundred seventy-two thousandths) acres, more or less.
The said land 572/1000 acre tract being subject to the part of the right of way for the said Apple Pie Ridge Road that is included within the boundary lines of said 1 and 572/1000 acre tract.
The said 1 and 572/1000 acre tract being a part of the 6 and 129/1000 acre tract of land that was conveyed by John R. Wilson and Irene J. Wilson, his wife, and R. William Wilson and Ruby E. Wilson, his wife, to Glenn I. Francis and Dorothy I. Francis, his wife, bearing date the 14th day of June, 1985, and recorded in the Office of the Clerk of the County Comission of Brooke County, West Virginia, in Deed Book No. 240, page no. 436.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 805 Apple Pie Ridge Rd, Wheeling, WV 26003-7872.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $7000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
