Activity:
To operate and maintain an existing combined wastewater collection system and an existing 1.6 million gallons per day wastewater treatment plant and discharge treated wastewater via Outlet 001 to the Ohio River at mile point 70.5. The system is designed to serve 16,000 persons or equivalents in the City of Follansbee and Hooverson Heights. Also to operate and maintain disposal systems, best management practices, and the nine (9) minimum controls for the direct discharge of sanitary wastewater and stormwater from Combined Sewer Overflow Outlet C002 to Alleghany Steel Run, a tributary of the Ohio River. Also to operate and maintain disposal systems and best management practices for the direct discharge of untreated stormwater through Outlet Nos. 007 and 008 to the Ohio River. An antidegradation review has been conducted and Tier 1 protection is provided for the uses specified in Title 47, Series 2 for the discharges from Outlet 001. Tier 1 protection shall be afforded for the discharge from Outlet C002 through implementation of the facility’s CSO Long-Term Control Plan. Also, to incorporate the requirements relative to Title 33, Series 2 of the West Virginia Legislative Rules for the processing and disposal of sewage sludge generated by the wastewater treatment plant. Sewage sludge generated and/or processed at the permittee’s facility shall be disposed of at a sanitary landfill by placing the sewage sludge in the landfill cell.

Compliance with the CSO requirements of the permit shall be attained through the Administrative Order No. 5784 and any amendments thereto. Also, compliance shall be attained through Consent Order No. 10224.
On the basis of review of the application, the “Water Pollution Control Act (Chapter 22, Article 11-8(a)),” and the “West Virginia Legislative Rules,” the State of West Virginia will act on the above application.
Any interested person may submit written comments on the draft permit and may request a public hearing by addressing such to the Director of the Division of Water and Waste Management within 30 days of the date of the public notice. Such comments or requests should be addressed to:

The public comment period begins August 21, 2026 and ends September 20, 2026.

Comments received within this period will be considered prior to acting on the permit application. Correspondence should include the name, address and the telephone number of the writer and a concise statement of the nature of the issues raised. The Director shall hold a public hearing whenever a finding is made, on the basis of requests, that there is a significant degree of public interest on issues relevant to the Draft Permit(s). Interested persons may contact the public information office to obtain further information.
